You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to create a PitchEngine account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account, including when signing in via Apple or Google.

PitchEngine offers auto-renewing subscription plans that unlock full access to AI-generated training programs and performance tracking features. By purchasing a subscription, you authorize us (via the Apple App Store) to charge your chosen payment method on a recurring basis at the price and interval presented at the time of purchase.

• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
• You can manage or cancel your subscription at any time through your Apple ID account settings. Deleting the App does not cancel your subscription.
• Any unused portion of a free trial period, if offered, will be forfeited if you purchase a subscription during the trial.
• All payments are processed by Apple and are subject to Apple's own terms and refund policies. We do not directly process or store your payment card details.

PitchEngine uses third-party artificial intelligence to generate personalized workout prescriptions and coaching recommendations based on the information you provide. This content is generated automatically and is intended for general fitness and performance guidance only.

The App does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional medical or coaching judgment. You should consult a qualified physician before beginning any new training program, and stop immediately if you experience pain, dizziness, or discomfort. We do not guarantee specific fitness results, and you rely on all training content entirely at your own risk.

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Reverse-engineer, decompile, or attempt to extract the App's source code or underlying AI models.
• Interfere with, disrupt, or attempt to gain unauthorized access to the App or its related systems.
• Share your account credentials with, or resell access to, any third party.
• Upload content that is unlawful, abusive, or infringes the rights of others.

The App, including its design, features, trademarks, and content (excluding personal data you submit), is owned by PitchEngine and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

By downloading the App from the Apple App Store, you acknowledge that these Terms are concluded between you and PitchEngine only, not with Apple. PitchEngine, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law. Termination of your account does not automatically cancel an active subscription managed through the App Store; you must cancel it directly via your Apple ID settings.

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated recommendations will be accurate, complete, or suitable for your specific physical condition.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Subject to this, to the fullest extent permitted by law, PitchEngine and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, arising from your use of the App or reliance on any training content, even if advised of the possibility of such damages.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
